Article 1 - Company details and definitions
1.1 Designer Stories is the trading name used for the website and online store. The seller is Designer Stories, established at Westplein 12, 3016 BM Rotterdam, The Netherlands, registered with the Dutch Chamber of Commerce under number [76664554, . Designer Stories can be contacted at info@designer-stories.com and +31 6 48420589.
1.2 Customer means any natural person or legal entity purchasing products from Designer Stories.
1.3 Consumer means a Customer who is a natural person acting for purposes outside their trade, business, craft or profession.
1.4 Products means all goods offered for sale through the website, including pre-owned and vintage luxury fashion items, accessories, jewelry, watches and other merchandise.
1.5 Agreement means any purchase agreement concluded between Designer Stories and the Customer.
Article 2 - Applicability
2.1 These Terms and Conditions apply to all offers, orders, purchases, deliveries and Agreements concluded through Designer Stories.
2.2 By placing an order, the Customer accepts these Terms and Conditions.
2.3 Any deviations from these Terms and Conditions are valid only if agreed in writing.
2.4 If any provision is invalid or unenforceable, the remaining provisions remain valid and enforceable.
2.5 Nothing in these Terms and Conditions limits mandatory consumer rights under applicable law.
Article 3 - Products and product information
3.1 Designer Stories specializes in the sale of pre-owned and vintage luxury goods. Unless expressly stated otherwise, Products are pre-owned.
3.2 Signs of wear, aging, usage, repairs or storage may be present. Normal signs of wear consistent with the description, photographs, age and prior use are not considered defects.
3.3 Product descriptions and photographs are prepared with care. Minor differences in colour or appearance resulting from screen settings, lighting or photography do not constitute a defect.
3.4 Customers should carefully review all photographs, descriptions, measurements and condition information before purchasing.
3.5 Additional information, photographs or condition reports may be requested before purchase.
Article 4 - Offers and Agreements
4.1 All offers are non-binding and subject to availability.
4.2 An Agreement is concluded after Designer Stories confirms acceptance of the Customer's order.
4.3 Designer Stories may refuse an order or request additional verification before accepting an order, for example where fraud prevention or payment verification is reasonably required.
4.4 If a Product is unavailable after an order has been placed, the Customer will be informed as soon as reasonably possible and any payment received will be refunded.
Article 5 - Prices and payment
5.1 Prices displayed on the website are stated in Euros (EUR), unless clearly indicated otherwise.
5.2 VAT is applied in accordance with applicable Dutch and European tax legislation. For second-hand goods, the Dutch margin scheme may apply, in which case VAT is not separately stated.
5.3 Import duties, customs charges, local taxes and other fees imposed by authorities outside the European Union are the responsibility of the Customer, unless mandatory local law provides otherwise.
5.4 Payment must be completed using one of the payment methods offered during checkout.
5.5 Designer Stories may cancel an order if payment has not been received within 12 hours after purchase.
5.6 Ownership of Products remains with Designer Stories until full payment has been received.
5.7 Any payment-related fee will be shown clearly before the Customer places the order, where applicable and legally permitted.
Article 6 - Shipping and delivery
6.1 Designer Stories ships worldwide. Orders above EUR 1,000 to eligible European destinations are shipped free of charge. Any applicable shipping costs are shown during checkout.
6.2 Orders are generally dispatched within 1-2 business days after payment has been received.
6.3 Estimated delivery times are indicative and are not guaranteed unless expressly agreed otherwise.
6.4 After dispatch, the Customer will receive tracking information where available.
6.5 Delivery delays caused by carriers, customs authorities, force majeure events or circumstances beyond the reasonable control of Designer Stories do not create a right to compensation, without prejudice to mandatory consumer rights.
6.6 For consumer orders, the risk of loss or damage passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, receives the Product. This does not apply where the Consumer independently appoints a carrier that was not offered by Designer Stories, to the extent permitted by law.
6.7 Collection from Designer Stories may be possible by appointment only.

Article 7 - Authenticity guarantee
7.1 Designer Stories guarantees that all Products offered for sale are authentic.
7.2 Products are inspected and authenticated using industry-standard procedures and expertise.
7.3 Customers with concerns regarding authenticity should contact Designer Stories promptly after discovering the issue. This request does not limit mandatory statutory rights.
7.4 Designer Stories may reasonably request written documentation from a recognized luxury authentication specialist and may request an assessment by a mutually accepted independent authentication service.
7.5 If a Product is proven not to be authentic, Designer Stories will provide a full refund in accordance with applicable law and the authenticity guarantee.
Article 8 - Condition and conformity
8.1 Products are sold in the condition described and photographed at the time of sale.
8.2 Customers acknowledge that vintage and pre-owned Products may not be in the same condition as newly manufactured products.
8.3 This does not affect the Customer's statutory rights if a Product does not conform to the Agreement or does not match the information provided before purchase.
Article 9 - Right of withdrawal and returns
9.1 Consumers purchasing online may have a statutory right to withdraw from the Agreement within 14 calendar days after receiving the Product, without giving a reason.
9.2 To exercise the right of withdrawal, the Consumer must notify Designer Stories within the applicable withdrawal period by an unequivocal statement, for example by email, or by using the Model Withdrawal Form published on the website.
9.3 After notifying Designer Stories, the Consumer must return the Product within 14 calendar days.
9.4 Unless mandatory law provides otherwise, the direct costs and risk of returning the Product are borne by the Customer. Designer Stories strongly recommends using insured and trackable return shipping appropriate to the value of the Product.
9.5 Returned Products should be sent back with all accessories, packaging, authenticity cards, labels, security tags and accompanying documentation received with the order.
9.6 The Consumer may inspect a Product only to the extent necessary to establish its nature, characteristics and functioning, comparable to an inspection in a physical store. If the Product has been handled beyond what is necessary, Designer Stories may deduct a reasonable amount for diminished value to the extent permitted by law.
9.7 Designer Stories will refund the amounts due within 14 calendar days after receiving the withdrawal notice. Designer Stories may withhold the refund until the Product has been received or until the Consumer provides evidence of having returned the Product, whichever occurs first.
9.8 Where legally required, the refund includes the standard delivery costs paid for the original shipment. Additional costs resulting from the Customer's choice of a more expensive delivery method are not refunded.
9.9 Statutory exceptions to the right of withdrawal apply where relevant.

Article 10 - Complaints
10.1 Complaints regarding Products or services should be submitted by email to info@designer-stories.com as soon as possible after discovery of the issue.
10.2 Designer Stories aims to respond to complaints within 14 calendar days. If additional investigation is required, the Customer will be informed.
10.3 This complaints procedure does not limit any statutory rights.
Article 11 - Intellectual property
11.1 Website content, including photographs, logos, text, branding, graphics, product descriptions and website design, is the property of Designer Stories or its licensors.
11.2 Content may not be copied, reproduced, distributed, published or used without prior written permission, except where permitted by law.
Article 12 - Privacy and data protection
12.1 Designer Stories processes personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).
12.2 Details regarding personal data processing are available in the Privacy Policy published on the website.
Article 13 - Force majeure
13.1 Designer Stories is not liable for a failure or delay in performing its obligations where the failure or delay results from circumstances beyond its reasonable control.
13.2 Force majeure may include natural disasters, pandemics, strikes, transport disruptions, customs delays, cyber incidents, governmental measures, supplier failures and telecommunications outages.
13.3 During force majeure, Designer Stories may suspend performance or terminate the Agreement where reasonably necessary, without prejudice to mandatory consumer rights and any applicable refund obligations.
Article 14 - Liability
14.1 Designer Stories is liable where required under applicable law.
14.2 Nothing in these Terms and Conditions excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights.
14.3 To the extent permitted by law, Designer Stories is not liable for indirect or consequential damage.
Article 15 - Third parties
15.1 Designer Stories may engage third parties in performing its obligations, including payment providers, authentication services, couriers and logistics providers.
Article 16 - Applicable law and jurisdiction
16.1 These Terms and Conditions and Agreements are governed by Dutch law.
16.2 Disputes may be submitted to the competent court in the Netherlands, without prejudice to mandatory consumer protection rights and any rights a Consumer may have under the law of their country of residence.
